AAJ Warns of Additional Regulations That Could Limit Consumers’ RightsWashington, DC – AAJ - Confirming American Association for Justice’s (AAJ) concern about midnight regulations, the Bush Administration rammed through a final rule that could give railroad corporations complete immunity from lawsuits.
In a rule that should have enhanced the safety of passengers and others impacted by railways, the Transportations Safety Administration (TSA) inserted boilerplate preemption language which instead attempts to limit the ability of states to protect their residents.

Preemption Clause Would Grant Blanket Immunity from Lawsuits |

Washington, DC - AAJ –The National Highway Traffic Safety Administration’s (NHTSA) new rule on school bus safety is “hypocritical,” requiring one thing for safety on small school buses, recommending another for large school buses, and then granting blanket immunity from civil justice should any injuries arise, according to the American Association for Justice (AAJ).
“NHTSA’s hypocrisy flies in the face of safety,” said AAJ President Les Weisbrod.

Minnesota's new first party good faith law |

On Friday, April 18, 2008, the Governor signed into law S.F. 2822,
creating Minnesota's new first party good faith law, § 604.18, which will be
"effective August 1, 2008, and applies to causes of action for conduct that
occurs on or after that date." The bill is available online on the Minnesota State Office of Revisor of Statutes Website, and MNAJ plans an informative seminar shortly to go over the standards of
proof and remedies available under the new law and practice tips on how to
employ it to assist consumers with their first party insurance claims.
